These Terms of Service ("Terms") govern your use of the website located at https://aimcfly.com and any related services provided by Mykalan, LLC ("AI McFly," "we," "us," or "our").

1. Service Description

AI McFly provides an artificial intelligence-powered virtual phone assistant service that:

• Answers incoming phone calls for your business
• Schedules appointments by accessing your connected Google Calendar
• Provides basic information about your business to callers
• Handles appointment inquiries and booking requests

Our service operates 24/7, though availability may be subject to maintenance windows and technical limitations.

2. Account Registration and Management

To use AI McFly, you must create an account and provide accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Keeping your account information up to date
• Connecting and maintaining your Google Calendar integration
• Providing accurate business information for the AI assistant to use

3. Google Calendar Integration

Our service requires access to your Google Calendar to function properly. By using AI McFly, you acknowledge that:

• We will read your calendar to check appointment availability
• We will create new calendar events when appointments are booked
• You maintain responsibility for your calendar accuracy and availability
• Service functionality depends on Google Calendar's availability and your continued authorization

You may revoke calendar access at any time, but this will disable core service functionality.

4. Subscriptions, Billing, and Payments

We offer monthly and annual subscription plans with the following terms:

• Payments are processed securely through Stripe
• We accept Visa, Mastercard, American Express, and Discover
• Subscriptions automatically renew unless cancelled
• You may cancel your subscription at any time through your account settings
• Billing occurs in advance for the selected billing period
• Price changes will be communicated with 30 days advance notice

5. Refund Policy

We offer a limited refund policy:

• New subscribers may request a full refund within 7 days of first payment
• Refunds beyond this period are at our sole discretion
• No partial month refunds for cancelled subscriptions
• Refunds required by applicable law will be honored

6. User Responsibilities and Acceptable Use

You agree to use our services responsibly and not to:

• Use the service for illegal, harmful, or fraudulent activities
• Attempt to reverse engineer, hack, or compromise our systems
• Share, sell, or transfer your account without written permission
• Use the service to harass, spam, or abuse others
• Provide false or misleading business information
• Overload our systems with excessive requests
• Use our service to compete with us or develop competing products

7. Service Limitations and Disclaimers

While we strive to provide excellent service, you acknowledge that:

• AI technology may not handle all call scenarios perfectly
• Service availability depends on third-party providers (Google, phone carriers)
• We cannot guarantee 100% uptime or call handling success
• Complex customer requests may require human intervention
• Appointment booking depends on your calendar accuracy and availability

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

The AI McFly service, including our AI technology, website, and related materials, are owned by Mykalan, LLC and protected by intellectual property laws. You retain ownership of your business data, while we retain ownership of our technology and service improvements.

10. Service Termination

Either party may terminate service:

• By you: Cancel anytime through your account settings
• By us: For Terms violations, non-payment, or service discontinuation with 30 days notice

Upon termination, we will cease processing calls and may delete your account data according to our data retention policy.

11. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability is limited to the lesser of $100 or the amount you paid us in the preceding 12 months
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for missed appointments due to technical issues
• You use our service at your own risk

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our service, violation of these Terms, or infringement of any rights of another party.

13. Dispute Resolution

Any disputes will be resolved as follows:

• Informal Resolution: We'll first attempt to resolve disputes through good faith negotiations
• Binding Arbitration: Unresolved disputes will be settled by binding arbitration in accordance with the rules of the American Arbitration Association
• Location: Arbitration will take place in St. Petersburg, Florida
• Class Action Waiver: You agree not to participate in class action lawsuits against us

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, USA, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms remain in full force and effect.

16. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or through our service at least 30 days before taking effect. Continued use of our service after changes become effective constitutes acceptance of the new Terms.
